Privacy policy
What happens to personal data when you visit this website and use the Dirk's Tic-tac-toe app. It is deliberately short — because little happens.
This policy follows the EU General Data Protection Regulation (GDPR) and German law. Where a German statute has no established English name, the German abbreviation is kept.
In short
This website sets no cookies, measures no traffic and does not analyse your behaviour. It loads nothing from third-party servers — no fonts, no scripts, no maps, no videos. That is why there is no consent banner: there is nothing to consent to.
The app itself transmits no game state to us and contains neither advertising nor an analytics tool.
1. Controller
The controller for the processing of personal data within the meaning of the GDPR is:
Kunert UG (haftungsbeschränkt)Hubertusstraße 134
44577 Castrop-Rauxel
Germany
Represented by Dirk Kunert
For data protection matters write to privacy@kunert-ug.com. Full provider details are in the legal notice.
2. Data protection officer
We have not appointed a data protection officer. The conditions of Section 38 BDSG (the German Federal Data Protection Act) are not met: fewer than twenty people are permanently engaged in automated processing of personal data, we carry out no processing requiring a data protection impact assessment, and we do not process data commercially for transfer or for market research.
3. Hosting
This website is hosted by STRATO AG, Pascalstraße 10, 10587 Berlin, Germany. STRATO processes the data arising when a page is requested solely on our behalf and on our instructions. We have concluded a data processing agreement with them under Article 28 GDPR.
The legal basis is our legitimate interest in providing this service securely and reliably, Article 6 (1) (f) GDPR.
4. Server logs
When a page is requested, the server automatically records what your browser transmits: the address requested, date and time, the volume of data transferred, whether the request succeeded, browser type and version, operating system, the previously visited page, and your IP address.
We need this to deliver the pages, keep the service secure and fend off attacks. The legal basis is Article 6 (1) (f) GDPR. Logs are deleted after seven days at the latest, unless they are exceptionally needed longer to investigate a specific security incident. They are not combined with other data.
5. Encryption
The connection to this website is encrypted with TLS. You can tell by the https:// before the address and the padlock symbol in your browser.
6. Contact by email
If you write to us, we process your email address and the information in your message in order to handle your request. We do not pass it on.
The legal basis is Article 6 (1) (b) GDPR where your enquiry relates to a contract or its preparation, otherwise Article 6 (1) (f) GDPR. We delete your message once the matter is settled and no statutory retention period applies.
Our mailbox is also hosted by STRATO AG; see strato.de/datenschutz.
7. No cookies, no tracking, no third-party content
This website sets no cookies. It embeds no fonts, scripts, maps, videos or other content from third-party servers. There is no traffic measurement and no analysis of your behaviour. Consent under Section 25 (1) TDDDG (the German act on data protection in digital services) is therefore not required.
8. Appearance setting
If you switch between light and dark appearance using the control at the top right, your browser stores that choice in its local storage. The entry is the word light or dark. It never leaves your device and allows no conclusions about you.
Because the storage serves solely to provide the service you explicitly asked for, it requires no consent under Section 25 (2) no. 2 TDDDG. You can delete the entry at any time through your browser settings.
9. In-app purchases
The Pro version is unlocked by an in-app purchase, which Apple handles. We receive neither payment details nor information identifying you personally — only the confirmation that a purchase took place. Apple's privacy terms apply in addition.
10. The Dirk's Tic-tac-toe app
The app processes no personal data on our servers.
Internet connection
The app needs an internet connection in order to show this policy and the instructions, and for in-app purchases. It is used for those purposes only.
Game state
Scores and the course of a game stay on your device. They are not transmitted to us and not analysed.
Advertising and analytics
The app contains no advertising and no analytics tool.
11. Links to third parties
This website links to third-party services, in particular the Apple App Store. Once you follow such a link, that provider's privacy terms apply. We transmit nothing to those providers when our pages are loaded.
12. Your rights
You have the right to access (Article 15 GDPR), rectification (Article 16), erasure (Article 17), restriction of processing (Article 18), data portability (Article 20), and to withdraw consent with future effect (Article 7 (3)). An informal message to privacy@kunert-ug.com is enough.
Right to object under Article 21 GDPR
Where we process data on the basis of Article 6 (1) (e) or (f) GDPR, you have the right to object at any time, on grounds relating to your particular situation.
If you object, we will stop processing your data unless we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing serves to establish, exercise or defend legal claims. We do not carry out direct marketing.
13. Right to complain
You may lodge a complaint with a supervisory authority. The one responsible for us is:
Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-WestfalenKavalleriestraße 2–4
40213 Düsseldorf
Germany
14. Changes to this policy
We update this policy when the law or our processing changes. The version published here is the one that applies.
